New Jersey Supplemental Security Income Attorneys

SSI Lawyers Serving Essex County, Hudson County and Beyond

Those who are disabled but do not qualify for Social Security Disability (SSD) benefits, or who receive SSD but in an insufficient amount, may be eligible to receive Supplemental Security Income.

At Greenberg Minasian, LLC, our New Jersey Supplemental Security Income lawyers help clients throughout the state who are struggling due to disabling conditions. We are here to answer questions as they arise and to guide clients through the complex system associated with government benefits programs like the SSI and SSD programs.

When Might a Person Receive Supplemental Security Income?

SSI is generally available to those who satisfy two conditions.

  • First, the applicant must meet the statutory definition of disability. Essentially, an applicant is considered disabled if he or she has a documented medical impairment that prevents him or her from holding gainful employment for a period that has lasted, or is expected to last, at least 12 months.
  • Second, the SSI applicant must either be ineligible for Social Security Disability benefits or be receiving monthly SSD payments of less than $760.

The disability criteria for adults seeking SSI benefits are the same as the criteria for those seeking SSD. The application process and the process for appealing a denied claim are largely the same as the SSD process as well. There are, however, different procedures to obtain SSI for children.

Those who have substantial assets or a certain amount of unearned income, such as income from a trust or pension, may not qualify for SSI. The attorneys at Greenberg Minasian, LLC, can analyze your specific medical and financial situation and give you an accurate assessment of your potential SSI eligibility.
